SC accepts Gen Hamid Gul`s petition regarding Bajour bombing

ISLAMABAD: The Supreme Court of Pakistan has accepted the petition of Gen (Retd) Hamid Gul pertaining to Bajour bombing, and adjourned the hearings for two weeks.

The Full Bench of The Supreme Court, comprising of Chief Justice Iftikhar Muhammad Chaudhry, Justice Mian Shakir ullah Jan, and Justice Syed Ashad has been formed, while Muhammad Akram Chaudhry appeared on behalf of Gen Hamid Gul.

The attorney of the plaintiff pleaded that since the citizens of Bajour are also Pakistani Nationals, the Supreme Court should direct the government to legislate for their protection and integrity.

He maintained that many tribal citizens are being killed daily, due to firing of Allied troops and Pakistani security forces, which was a blatant violation of article 9 of the constitution, and requested that Supreme Court should invoke article 245 directing the government to provide security for the tribal borderland.

Article 184(3) provides protection for rights of Public and falls under the jurisdiction of The Supreme Court. Although article 247(3) restricts the Apex Court in reference to FATA affairs, the Constitution also empowers it to protect the basic civil rights of masses, and integrity of Country`s borders.

The Chief Justice is said to be considering the possibility of reviewing the petition, since it was political in nature, while the political crisis were rife, hence he adjourned any further hearing for two weeks.

Notables like, Gen(R) Asad Durrani, Roedad Khan, Imran Ullah Kahn, Iftikhar Sarohi, Jamshed Gulzar Kiani, Aslam Beg, Qazi Hussain Ahmad, Mian Aslam, and Maulana Ghafoor Haidri were also present on the occasion.

Some very interesting wit and pleasantries were also exchanged between the participants.

im very pleased 2 see that at least some one loud his voice for innocent and poor people of bajour,now supreme court should accept this petition,its also question of integrity and reputation of supreme court some good and bold decesion of supreme court can restore the respect and give confidence 2 pakistani people they can trust their courts.
