ISLAMABAD: Counsel for Dr Abdul Qadeer Khan, Barrister Javed Iqbal Jaffrey has lamented that Lahore High Court (LHC), while under government pressure is not hearing his habeas corpus petitions filed by him to secure release of his client.
He said this while addressing a press conference here Saturday, whence he said that despite the fact that President General Pervez Musharraf has announced a pardon for Dr A Q Khan, it has not been implemented so far, which was quite unbecoming of a chief executive of a country since his words and deeds are out of synch with each other.
"When I filed habeas corpus petition, LHC rejected my petition saying that since Dr Qadeer is at Islamabad therefore, I should approach Lahore High Court Rawalpindi bench. But when I filed application in Rawalpindi bench, Justice Abdul Shakoor Paracha issued an administrative order regarding my application that it was not maintainable for the very reason that I had not even the remotest relations with Dr A Q Khan despite the fact I know him since the last 40 years, and Dr Qadeer is writing a book on me."
Citing article 199 of the constitution he said that "any familiar person (acquaintance) can file habeas corpus writ under constitution, while Dr AQ Khan is benefactor of this nation suffering ill health. Therefore, LHC should accept my application and secure release of Dr Qadeer Khan."
He has appealed to the nation to come on the streets and voice protest against the detention of Dr A Q Khan just like it has shown solidarity with the Chief Justice of Pakistan, Iftikhar Muhammad Chaudhry.
