ISLAMABAD: Supreme Court's larger bench has disposed of matter of arrest of Director General (DG) FIA, Tariq Pervez on the assurance of attorney general of Pakistan that Hafiz Abdul Basit will be released.

The larger bench of SC comprised of Chief Justice (CJ) Iftikhar Muhammad Chaudhry, justice Fakir Muhammad Khokhar, justice M Javed Buttar, justice Nasir ul Mulk, justice Fakir Muhammad Khokhar and justice Raja Fayyaz Ahmad.

The SC   expressed its resentment over non-production of Hafiz Abdul Basit in the court, and while addressing the DG FIA, CJ said " had we recorded statement of DSP Tariq Mehmood on Monday, the evidence against you would have come and you would have been arrested."

Attorney General (AG) Malik Qayyum told the court that he had contacted all the agencies and Hafiz Abdul Basit was now in the custody of political agent Khyber agency. Promising that Hafiz Abdul Basit will be released tonight or he will be produced in the court the next day.

CJ remarked " Show us that man who has been arrested in such a major case". AG assured the court Hafiz Abdul Basit would be brought in Islamabad as all the information about him had been collected.

The SC ordered Hafiz Abdul Basit be brought in the office of DG FIA Tariq Pervez on Tuesday night till 8 p. m and he be handed over to his uncle Hafiz Abdul Nasir and its report be faxed to registrar supreme court.

It may be mentioned Hafiz Abdul Basit was arrested in the case of life attempt on president Musharraf. Tariq Pervez, and was Additional Inspector General CID Police at that time. Hafiz Basit was handed over by DSP Tariq to captain Imran of military intelligence under the directives of Tariq Pervez.

The apex court on the assurance from AG adjourned the hearing till September, 4,.

In the second case Dr Imran Munir was presented, and he told the court that he was brought from Mangla at 7 a.m and was kept in FIU till 11 a.m. " I was handcuffed.  I was blindfolded when I was produced in SC. I was not brought to Adiyala jail", he stated.

CJ expressed displeasure over it and asked deputy attorney general that court was told on Monday Imran Munir was being brought from Mangla and he had reached near Dina at 5.30. Why was such a wrong statement ever made.

Justice Fayyaz Ahmad observed that wrong statement was given and court would take notice of it.

CJ said, " we had ordered the production of Imran Nazir at 11 a.m , and waited  till evening , while  Brig (Retd) Javed Iqbal Cheema had told as late as  5.30 , that he was on the way.

Abdul Mujeeb Pirzada and Col (Retd) Muhammad Akram appeared on behalf of Imran Nazir.

The SC secured release of Imran Nazir from military custody and handed over him to civil administration. IG Islamabad Iftikhar Ahmad Chaudhry was summoned specially.

The SC handed over Imran Nazir to IG Islamabad and ordered he would undergo treatment for 15 days in PIMS. Special guards be deployed and he should not be handed over to any intelligence agency, while Counsels and relatives of Imran Nazir would be allowed to meet him.

The SC adjourned the hearing for further 15 days. Brig (Retd) Cheema was asked to identify the person from ministry of defense who had given wrong report in respect of Imran Nazir.

In the third case Aleem Nasir was produced and the court was told he was arrested from Allama Iqbal airport Lahore on June, 8, ISI officers told Aleem Nasir that his flight was to take off after 35 minutes and they had to interrogate him.

Aleem Nasir told, " I was taken to headquarters and several questions were asked from me. They asked me about the names of country which I visit frequently. I told them I trade in stones and I am German National. I was threatened that I would be handed over to US.

CJ asked him from what areas he used to purchase stones. Aleem Nasir told he used to purchase stones from Gilgit, Peshawar, Wana and other areas.

Aleem Nasir further submitted he was flown to Islamabad in a Fokker plane.

CJ remarked that ISI was not a law enforcement agency or customs department that it should interrogate the people.

Aleem Nasir told his all documents passport were taken by ISI personnel. " I am not a Pakistani and the card was issued to me for 7 years", he informed.

CJ remarked the court should be informed under what law he was kept in captivity. It is a sensitive issue and Col Lodhi be summoned, he directed.

Col Lodhi appeared in the court after a while.

Aleem Nasir told the court he had never seen the men weeping. But where I was kept several people were beaten up mercilessly and he personally heard people weeping bitterly in Jails, which were established in the basements.

AG Malik Qayyum said "May God save us from such situation."

CJ remarked who these people were and under what law they were working, and where lies the guarantee that he will not be arrested again.

AG told that he gives this guarantee that he will not be arrested.

The SC ordered for release of Aleem Nasir after hearing the arguments and issued directives that he should not be apprehended again, and ordered that the government return his passport so that he could proceed to Germany.

Geo. Aaj, ARYOne, DAWN, Indus, BusinessPlus and all other electronic channels should back up the CJP and the whole jury in the missing peoples' affairs and expose the culprits. This is a stain on the government and one recalls the casual attitude of the President, who had remarked that some of the missing people had gone in hiding on their own accord. The facts coming to light show how lightly the President had treated this matter. Some of the culprits in Agencies should be put in jail and the sphere of judiciary should be expanded to the full and prisons should be streamlined and there workings should be monitored by electronic media.
Dispense of justice is the first priority of a polity and Musharraf's government doesn't present a face saving picture.
